1. Definitions

Data protection is a complex issue. We have compiled a few basic concepts and their meaning for you to make understanding this Data Privacy Statement easier.

Processing” (“DP” for short) in the definition of Art. 28 EU General Data Protection Regulation (GDPR) (formerly “commissioned data processing”) (“CDP” for short) according to Sec. 11 German Federal Data Protection Act (BDSG) is understood to mean a service in which personal data are gathered, processed and/or used under a contract and according to the instruction of the so-called data controller by a service provider (processor pursuant to the GDPR and data processor pursuant to the BDSG). Before such a work order is given to a service provider, we conclude a special contract with the service provider and ensure additional measures for the protection of your personal data.

Cookies” are small text files that are stored on the end device you use (e.g. computer or smartphone) and which store certain settings and data for exchange with our system via your browser. A cookie usually contains the name of the visited website from which the cookie data have been sent, information about the age of the cookie and an alphanumeric identifier. Cookies enable the system to recognise the user’s device and make possible default settings available immediately.

Third parties are all natural persons or legal entities or bodies other than the data subjects, the data controller, the data processor and the persons, who are authorised

under the direct responsibility of the data controller or data processor to process the personal data, cf. Art. 4 (10) GDPR. Thus, a third party is not involved, e.g. if personal data are transferred to a service provider in the course of a contracted processing according to Art. 28 GDPR or Sec. 11 BDSG.

IP addresses are numerical sequences that can be attributed to individual IT devices or a group. The IP permits attributing data to the right recipient similar as a postal address does. “Personal data” means all information, which relates to an identified or identifiable natural person, in particular first and last name, date of birth, email address, residential address, as well as bank and payment data, but also health data, cf. Art. 4 no. 1 GDPR (particular information about an identified or identifiable natural person according to Sec. 3 (1) BDSG).

Controller” according to Art. 4 no. 7 GDPR (formerly “data controller” pursuant to Sec. 3 (7) BDSG) is any person or body that decides on its own or jointly with others about the purposes and means of the processing of personal data (presently: the website operator).

3. Use of the website

3.1 Cookies

On each access to this website, data are logged, which also applies to the retrieval of files. For this purpose, we use your IP address or cookies, in order to collect data, which takes place, among other, via your browser, your computer and the subpages you have visited. We need these data to make the visit to this website as pleasant as possible. However, we do not create any individual profiles based on your user behaviour. The analysis of the user behaviour takes place in anonymised form in all cases. Basic use of the internet offer is usually also possible without cookies. However, we cannot rule out that the use of the website will be limited or less user friendly. Most common browsers permit deactivating cookies or limiting them for certain websites. Browsers

regularly also have the possibility to let you know as soon as cookies are set. You can delete cookies at any time from the hard drive of your end device. However, we cannot rule out that the use of the website will be limited or less user friendly in this case as well.

3.2 Transfer of your data, use of service providers

We gather and use your data in accordance with the legal requirements and solely for our own purposes. Your data are not transferred to so-called third parties, unless there is a legal duty to do so or you have consented to the transfer. If we engage additional service providers to facilitate our offer and insofar as we possibly grant them the necessary access to your data, we have of course concluded a contract for commissioned data processing (“DP Contract” for short) according to Art. 28 General Data Protection Regulation or Sec. 11 BDSG with our service providers for the data processing (“Processors” for short). We will continue to be responsible for the protection of your data. The contracted service providers are not deemed so-called third parties.

3.4 Communication via email, contact form, telephone or fax

If you should contact us via email, fax, telephone or by means of one of the activated contact forms, we will use your information for contacting you and advising you for the specific purpose that we can conclude from your enquiry according to your wishes. Further use of your personal data will take place only if a legal regulation permits or you have given your consent.

3.5 Period of the data use/storage

Your personal data will be deleted, unless legal retention obligations are opposed, and if you have asserted a right of erasure when the data are no longer required for the fulfilment of the purpose pursued by the storing or if their storage is impermissible for other legal reasons.

3.6 Place of data use

Your will normally be processed in Germany. In cases of exception, information that you transfer to us can be stored on servers within the European Union (EU). As the “Controller”, we will inform you if we should deviate from this.

4. Integration of third-party services and contents

4.1 General remarks

It can happen that contents of third parties, for example, videos of YouTube, map material of Google Maps, RSS feeds or graphics of other websites are integrated within our online offer. This always presupposes that the providers of these contents (hereinafter referred to as “External Providers”) recognise the user’s IP address. This is required because they cannot send contents to the browser of the respective user without the IP address.

. The IP address is therefore required to display these contents. We work towards using only such contents of providers that respectively use the IP address merely to deliver the contents. However, we have no influence over whether the External Providers store the IP address, e.g. for statistical purposes. We inform the users of this if we know of it.

4.2 YouTube

YouTube videos are embedded in our website and can be played directly from our website. The service is operated by the YouTube video platform, YouTube LLC with headquarters in 901 Cherry Avenue, San Bruno, CA 94066, USA (“YouTube”). YouTube is a company affiliated with Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”).

The YouTube videos are embedded in the so-called “extended data protection mode”, i.e. no data about you as a user will be transferred to YouTube if you do not play the videos. Such a data transfer, which cannot be influenced by us, will be started only once you activate the videos. You can prevent YouTube from storing cookies by making the corresponding setting in the browser software. More details about the processing of the data as relates to YouTube and your related rights and options for adjusting the settings for the protection of your privacy can be found in the terms of use and the data privacy policy of YouTube: www.youtube.com/t/terms, policies.google.com/privacy.

The aforementioned cookie-based data processing takes place on the basis of Art. 6 (1) lit. f) GDPR for the protection of our legitimate interests. Our legitimate interests in this respect are in particular to be able to make a technically optimised website available to you with a user-friendly design as appropriate to needs, including corresponding ads (also on external provider pages) and to ensure the security of our systems.

4.3 Use of “location-specific browsing” or “geo-localisation” with Mozilla Firefox

When calling up our website using the internet browser Mozilla Firefox, you will be asked to transfer your location. If you agree to the transfer, Firefox will gather data about nearby mobile communication access nodes and the IP address of your computer, and transfer these to Google Location Services for identification of your approximate location. The approximate location will be transferred to this website. This website uses the data about the approximate location to be able to deliver information that is more suitable to you or to save time for you for searches. Google Location Services delivers the approximate position of your location (e.g. degrees of longitude and latitude). 4.4 Use of Google Analytics

This website uses the web analysis service “Google Analytics” of Google Inc., by which so-called “cookies” (small text files) are stored on your computer. These “cookies” permit an analysis of the use of the website. The information generated by a cookie about your utilisation of this website is generally transmitted to a server of Google Inc. in the USA and also stored there. Your IP address will normally be truncated by Google before then, while still inside of the Member States the European Union or in other signatory states of the Agreement on the European Economic Area (EEA). In cases of exception, your complete IP address can be transmitted to a U.S. server of Google Inc. and then be truncated only after it gets to the USA. IP anonymisation

We have activated the IP anonymisation function on this website. Through this function, your IP address will be truncated by Google inside of the Member States of the European Union or in other signatory states of the Agreement on the European Economic Area before the transmission to the USA. The complete IP address will only be transmitted in exceptional cases to a server of Google in the USA and it will be truncated there. Google will use this information on behalf of the operator of this website, in order to analyse your utilisation of the website, compile reports about website activities, and perform additional services for the website operator, which relate to the website utilisation and internet use. The IP address transmitted from your browser in the context of Google Analytics will not be combined with other data of Google.

Contracted data processing

We have concluded a contract with Google for contracted data processing and we fully implement the strict requirements of the German data protection authorities for the use of Google Analytics.

4.5 Google Web Fonts

For a consistent display of fonts, this page uses so-called web fonts that are provided by Google. When retrieving a page, your browser loads the needed web fonts in your browser cache to display texts and fonts correctly.

For this purpose, the browser used by you has to establish a connection with the servers of Google. This way, Google will be informed that our website has been retrieved via your IP address. Google Web Fonts are used in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest in definition of Art. 6 (1) lit. f) GDPR.

4.6 Google Maps

This website uses the maps service Google Maps via an API. The provider is Google Inc. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.

To use the features of Google Maps, it is necessary to save your IP address. This information is usually transferred to a server of Google in the USA and stored there. The provider of this website has no influence on this data transmission.

We process the following categories of data that we have received from you personally: (title, last name, first name, address, phone number, mobile phone number, email address). In addition, further information that is required for the decision on the application will be stored if you provide us with the information.

Bender GmbH will use your data exclusively for transacting its own business and not transfer it to third parties.

The data that we have received from you personally will be processed for the purpose of initiating a contract in the context of concrete job postings or speculative applications. The data processing serves for the purpose of establishing an employment relationship and its special legal basis follows from Art. 88 (1) GDPR in conjunction with Sec. 28 (1) BDSG (new version).
Pursuant to Art. 15 to Art. 22 GDPR, you have the following rights when the legal requirements are fulfilled: right of confirmation, correction, erasure, restriction of the processing, data portability. Moreover, pursuant to Art. 14 (2) lit. c) in conjunction with Art. 21 GDPR, you have a right to object to the processing on the basis of Art. 6 (1) lit. f) GDPR.

In the case your application is declined, you data will be deleted after 6 months, unless you have granted consent to storage for a longer period.
